LossLink Terms and Conditions of Use

Welcome to LossLink’s Terms and Conditions of Use (these “Terms”). This is a contract between you and LossLink, operated by Katherine Lazar. Before you use the LossLink website (“Site” or “LossLink”), please read these Terms to understand your rights and obligations. By accessing, viewing, or using the Site, you agree to be legally bound by these Terms.

1. LossLink Rules

Before you can use our Site, you will need to register for an account (“Account”). To create an Account, you must:

  • Provide your first name, date of birth, and a valid email address.
  • Be at least 18 years old.
  • Be legally permitted to use the Site in your country.

By creating an Account, you authorize us to access, display, and use certain information provided during registration. For more information about what information we use and how we use it, please refer to our Privacy Policy.

You cannot use another user’s Account without their permission.

You cannot create duplicate LossLink accounts, unless requested by LossLink for technical reasons.

If you decide to leave, you can delete your Account at any time by going to the ‘Settings’ screen of your Account when you are logged in, and following the steps shown. We will save your profile information in case you decide to restore your Account; please see our Privacy Policy for more information. If you would like your content or profile information to be deleted, please contact us at [email protected].

LossLink reserves the right to terminate or suspend any Account at its sole discretion, at any time, without liability and without prior notice.

2. Types of Content

There are three types of content on the Site:

  • Content that you upload and provide (“Your Content”).
  • Content that other members provide (“Member Content”).
  • Content that LossLink provides (“Our Content”).

We Don’t Allow Certain Content

We want our users to freely communicate on LossLink, but we impose restrictions on content that:

  • Contains language deemed offensive or likely to harass, upset, embarrass, alarm, or annoy any other person.
  • Is obscene, pornographic, or otherwise may offend human dignity.
  • Is abusive, insulting, or threatening, or promotes or encourages racism, sexism, hatred, or bigotry.
  • Encourages illegal activity, including, without limitation, terrorism, inciting racial hatred, or submission of content constituting a criminal offense.
  • Is defamatory or libelous.
  • Relates to commercial activities (including, without limitation, sales, competitions, advertising, links to other websites, or premium line telephone numbers).
  • Involves the transmission of “junk” mail or “spam”.
  • Contains any spyware, adware, viruses, corrupt files, worm programs, or other malicious code designed to interrupt, damage, or limit the functionality of any software, hardware, telecommunications, networks, servers, or other equipment.
  • Infringes any third party’s rights (including, without limitation, intellectual property rights and privacy rights).
  • Shows another person without their consent.
  • Breaches the terms of our Community Guidelines.

We operate a zero-tolerance policy for this kind of content.

To ensure a safe environment, you must also comply with our Community Guidelines when engaging with the LossLink community.

Our moderation team reviews Your Content and Member Content to ensure compliance with these Terms. We may remove any of Your Content that breaches our Community Guidelines, restrict or prohibit your access to the Site, and/or delete your Account if you breach any of the restrictions in these Terms or the Community Guidelines.

Your Content

You are responsible and liable for Your Content and will indemnify, defend, release, and hold us harmless from any claims made in connection with Your Content.

You may not display any personal contact or banking information on your profile page. If you choose to reveal any personal information to other users, it is at your own risk. We encourage caution in disclosing details about yourself to third parties online.

LossLink is a public community, so Your Content will be visible to other users worldwide. By uploading Your Content on LossLink, you grant us a non-exclusive, royalty-free, perpetual, worldwide license to use Your Content in any way, including editing, copying, modifying, adapting, translating, reformatting, creating derivative works from, advertising, distributing, and making it available to the general public.

We may assign and/or sublicense the above license to our affiliates and successors without any further approval by you.

We have the right to remove, edit, limit, or block access to any of Your Content at any time, and we have no obligation to display or review Your Content.

Member Content

Member Content belongs to the user who posted it and is stored on our servers and displayed via the Site at the direction of the user providing the Member Content.

You do not have any rights in relation to other users’ Member Content and may only use other users’ personal information to the extent that it matches LossLink’s purpose. Misuse of other users’ information, including for commercial purposes or harassment, is prohibited and may result in termination of your Account.

Our Content

All other content on LossLink belongs to us. Any text, content, graphics, user interfaces, trademarks, logos, sounds, artwork, and other intellectual property appearing on LossLink are owned, controlled, or licensed by us and are protected by copyright, trademark, and other intellectual property law rights.

We grant you a non-exclusive, limited, personal, non-transferable, revocable license to access and use Our Content, without the right to sublicense, under the following conditions:

  • You shall not use, sell, modify, or distribute Our Content except as permitted by the functionality of the Site.
  • You shall not use our name in metatags, keywords, or hidden text.
  • You shall not create derivative works from Our Content or commercially exploit Our Content in any way.
  • You shall use Our Content for lawful purposes only.

We reserve all other rights.

3. Restrictions on the Site

We do not tolerate bad behavior on LossLink. You can report any abuse or complain about Member Content by contacting us at [email protected].

Scraping or replicating any part of the Site without our prior consent is expressly prohibited.

4. Privacy

For information about how LossLink collects, uses, and shares your personal data, please check out our Privacy Policy.

5. Third-Party Services

The Site may interoperate with third-party platforms and services. By using the Site, you agree to comply with any applicable terms, conditions, or requirements of these third-party providers.

6. Disclaimer of Liability

Your use of the Site is at your sole risk. Our Content, materials, and information on the Site are provided “as is” and “as available” for general information purposes only. The Site is not a substitute for professional advice. We make no representations, warranties, or guarantees that the content on the Site is accurate, complete, or up-to-date.

7. Limitation of Liability

We will not be liable for any indirect, incidental, special, consequential, or exemplary damages, including loss of profits, goodwill, data, or other intangible losses, resulting from your use of the Site. Our total liability to you for all damages will not exceed the amount you have paid us in the last six (6) months.

8. Changes to These Terms

We may update these Terms from time to time. The updated Terms will be posted on this page, and the date of the latest revision will be indicated at the top. Your continued use of the Site after any changes constitutes your acceptance of the new Terms.
